These terms govern your use of LendPaper — the tools, calculators, references, and any account you hold at lendpaper.com. They're written plainly on purpose. By using LendPaper, you agree to them. If you don't agree, don't use the site.
LendPaper is software, not a lender. Everything our tools produce is a preliminary estimate, not an offer or financial advice. You're responsible for the accuracy of what you enter and for how you use what comes out. Final loan terms always come from the funding lender, not from us.
LendPaper is operated by LendNote LLC, a Massachusetts limited liability company. LendPaper is a technology software platform for commercial lending professionals. LendPaper is not a lender, mortgage broker, financial institution, investment advisor, insurance company, or any other type of regulated financial entity. LendPaper does not originate, underwrite, fund, or service loans, and does not hold any lending license, broker license, or financial services authorization in any jurisdiction. Nothing on this platform should be construed as LendPaper acting in any financial, fiduciary, or advisory capacity.
All documents, calculations, schedules, and scenario outputs produced through LendPaper are preliminary estimates only. They do not constitute a loan offer, commitment to lend, binding financial agreement, term sheet, or professional financial, legal, or tax advice of any kind. Actual loan terms, rates, fees, and approval decisions are determined solely by the funding lender upon completion of underwriting and final review.
The full disclaimer governing generated documents is at lendpaper.com/legal/estimates and is incorporated into these terms by reference.
All data inputs, financial figures, loan parameters, borrower information, and scenario assumptions contained in any generated document were entered exclusively by the originating user — the lender, ISO, or broker who created the document using LendPaper software. LendPaper does not review, audit, verify, or validate any inputs provided by users. The accuracy of any calculations, estimates, projections, or outputs is solely dependent on the accuracy of the information provided by the originating user. LendPaper expressly disclaims all responsibility for errors, omissions, or inaccuracies resulting from user-provided data.
If you generate or share documents with borrowers or end-clients, you — the originating user — are solely responsible for ensuring those documents comply with applicable federal, state, and local laws and regulations governing financial disclosures, including without limitation the Truth in Lending Act (TILA), the Equal Credit Opportunity Act (ECOA), and any applicable state-level lending disclosure requirements. LendPaper does not provide compliance guidance and is not responsible for the regulatory fitness of any document as shared with a borrower or end-client.
Parts of LendPaper are available by invitation and require an account. When you create one, you agree to:
LendPaper and its operators may suspend or terminate access at any time, with or without notice, for violation of these terms, misuse of the platform, or as needed to protect the service and its users. You may stop using LendPaper, and may request deletion of your account, at any time.
You agree not to:
LendPaper is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We work hard to keep the tools correct and the service up, but we make no promise that the service will be uninterrupted, error-free, or that any output is suitable for your particular transaction.
To the fullest extent permitted by applicable law, LendPaper and its operators, employees, affiliates, and licensors shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages arising from the use of or reliance upon the platform or any information contained in a generated document, including but not limited to financial loss, failure to obtain financing, business interruption, or decisions made on the basis of estimated figures.
The LendPaper name, logo, site design, and software are the property of LendPaper and its operators. Documents you generate with your own inputs are yours to use in your lending work, subject to these terms and the disclaimers they carry.
How we handle data is described in our Privacy Policy, which is part of these terms.
If we make material changes to these terms, we'll update the "Last updated" date at the top of this page. Continued use of LendPaper after changes constitutes acceptance of the updated terms.
